Appeal Against Taxi Licence Revocation Dismissed for Ashford Driver

Mr. Tashil Hashemi’s taxi licence revoked after multiple complaints; Appeal dismissed and ordered him to pay £4,000 in costs to Ashford Borough Council.

Ashford Borough Council’s decision to revoke a taxi driver’s licence was upheld by Margate Magistrates Court on 22 November 2024. The driver, Mr. Tashil Hashemi, who held his licence since 2011, failed to convince the court of his fitness to continue working as a licensed taxi driver.

A History of Complaints

The council presented evidence labeling Mr. Hashemi as their “most complained about driver.” Complaints and allegations against him included:

  • Rude and abusive language: Incidents involving customers, NHS security staff, and civil enforcement officers.
  • Refusal of fares: Refusing service to passengers without reasonable cause.
  • Poor driving standards: Allegations of careless driving and endangering others.
  • Misuse of taxi ranks: Using ranks as private parking spaces for non-taxi purposes.
  • Obstructive behavior: Attempts to hinder Licensing Officers during inspections.

Given the gravity and persistence of these issues, the council’s Regulatory Sub-Committee revoked Mr. Hashemi’s licence in January 2024.

Basis for the Appeal

Mr. Hashemi challenged the revocation, arguing he was still a “fit and proper” person to hold a taxi licence. Representing himself with support from a McKenzie Friend, he contended the council’s assessment was unfair.

The court, however, identified numerous instances of inappropriate behaviour, including attempts to prevent a Licensing Officer from inspecting his hackney carriage.

Court's Findings

District Judge praised Ashford Borough Council's Licensing team for their thorough investigation and adherence to due process. The court determined that Mr. Hashemi failed to meet the required standards for a taxi driver and upheld the council’s decision to revoke his licence.

Financial Repercussions

In addition to losing his appeal, Mr. Hashemi was ordered to pay £4,000 in legal costs to Ashford Borough Council within 28 days.

The case underscores the importance of professionalism and accountability among taxi drivers. Ashford Borough Council remains firm in ensuring the safety and trustworthiness of its licensed drivers.
